On our website we added some of the contents after the forms. When people fill the form we are sending the content via email.
Form has 2 check box, one is for GDPR(content to process) and the other one for Marketing communication(consent to communicate).
If they do not fill the Marketing communication(consent to communicate), Hubspot does not allow us to send the email/document.
Is it how it works? Cuz basically we don’t send marketing email we send the report that they requested to get the document.

Great question! Before I start, this post does not constitute legal advice. Always discuss data privacy topics with your data privacy officer or a professional. Also, the interpretation of data privacy regulations can be different from country to country.
In a lot of countries, sending a confirmation email regarding something that a contact has previously requested (by filling out a form) can be considered a transaction, as long as it doesn’t contain promotional messages. The confirmation email is something that is expected. HubSpot has created a separate product for this, called transactional email: How to Use Transactional Emails to Send Relationship-Based Emails in HubSpot This is a pricey add-on which allows you to send an email even when a contact has chosen to not opt into any subscription.
If purchasing this add-on is not an option, you would have to uncheck the box for “Only allow marketing emails to be sent to contacts who have a legal basis to communicate” in the GDPR settings, see here. HubSpot then lets you send emails to contacts, using subscriptions that they’ve not explicitly opted into. (Whether that is compliant with data privacy regulations where you’re doing business is another question.) This means that you need to keep track of the consent status of contacts because HubSpot won’t anymore.
Generally, I’d recommend placing whatever you’re offering for download on a so-called “Thank you” page. After someone fills out a form, redirect to the “Thank you” page and include a link to the document. If they don’t want your marketing communication, then that’s what it is. If you’re content is relevant for them, they’ll come back. You can also add additional sentence to the checkbox text, saying “Check this if you want to receive the download via email”.
