HubSpot Forms - GDPR Checkbox question

Hi All,

We have some forms with the GDPR Consent checkbox that the user check the check the checkbox if he wants to be unsubscribe from email marketing, but we still need to be able to send him operational emails if he unsubscribe by checking the checkbox: “Yes, I’d like to get pricing insights, webinar invites but not any commercial spam”:

When we inserted the contact as a test, the marketing contact status set to: “True”

Can we set automation to trigger those changes? or we need to create a custom checkbox field and then create a workflow?

Thanks!

Hi @OBetzalel,

You might be confusing some things. Marketing contact status (as shown in the sidebar) is a billing feature, it doesn’t say anything about consent: Understand marketing contacts

If a contact is fully unsubscribed from all email, the only way to send them non-marketing emails is via the transactional add on: How to Use Transactional Emails to Send Relationship-Based Emails in HubSpot

Other emails will be held back by HubSpot, if the contact is unsubscribed from all email. This cannot be bypassed by opting a contact in manually.

If you want a form checkbox to unsubscribe a contact, yes, that would have to be via a workflow. (There’s a workflow action “Manage communication subscriptions”.)

Let me know if you have any follow up questions!

@karstenkoehler Not sure I understand:

1. You saying that the message: “Yes, I’d like to get pricing insights, webinar invites but not any commercial spam” in our form not related to the GDPR of marketing emails and data processing?

2. If I set the contact as Non-Marketing contact + Unsubscribe from “Marketing Emails” if he doesn’t mark the checkbox: “Yes, I’d like to get pricing insights, webinar invites but not any commercial spam” - Why it’s not okay? We don’t want them to consume from our limit of 15,000 contacts.

And thanks i’ll create the custom checkbox with the automation :slightly_smiling_face:

No, that’s not what I meant. You brought up this:

This is the marketing contact status and purely billing-related. It doesn’t say anything about consent.

If you have a subscription checkbox (not a custom property) on your form for “Yes, I’d like to…” then this information is stored as the opt-in in a subscription type: Manage your contacts' messaging subscriptions

Your original request presented things slightly differently. If a contact does not check the box, there isn’t any need to unsubscribe the contact from all emails, as long as you only email contacts who are opted in or as long as you check the ‘Legal basis required’ optoin in the GDPR setting: Manage data privacy settings in your HubSpot account

If you have any automated email after the form submission, the marketing contact status is still needed. If not, then correct, you can set contacts coming through the form as non-marketing contacts.

You could however also approach this differently: In the form settings, choose to not make all incoming contacts as marketing contacts. Then set up a contact-based workflow that checks which contacts have submitted the form and who have the opt-in for the subscription type, then set them as billable marketing contacts.

@karstenkoehler Thank you!

So last question, If I just set them as “Unsubscribe from marketing emails” and keep them as Marketing Contacts, I can still send them automated emails and Pricing insights emails right? unless they unsubscribe in the subscription page for Pricing Insights emails?

Thanks!
