Having Dynamic Marketing Consent Checkbox

Hi Community!

 

I have one question about one of the essential fields we use in the forms. 

 

As a marketing automation specialist, I'm responsible for GDPR compliance when we collect data and marketing consent via forms. In addition, as you know, there are different regulations for each region when the subject is GDPR. For example, it's completely different when I research how to use the consent checkbox in the US and the UK.

Therefore, I want to learn your best practices for dynamic marketing checkboxes according to the visitor's location. For example, I want to add a checkbox when the visitor is from Europe and want to avoid adding the checkbox when the visitor is from the US.

The default consent settings in a HubSpot form cannot be made conditional. If you want to add conditional logic, you'd have to create custom checkboxes and set up automation in the background (requiring a Professional subscription).

 

Generally, I'd recommend using a specific form for each region, e.g. a UK form, a US form, etc. That way, you can design each form specifically for each region and place them on the UK version of the page, the US version etc.

 

If this is not an option, you would have potentially create custom checkboxes for subscription consent and data processing consent that display dynamically depending on a previous country selection.

 

If you choose this route, you need contact-based workflows to update the subscription status of contacts and the Legal basis for processing contact's data based on the custom checkboxes. (If you use the default HubSpot forms options, HubSpot takes care of this automatically.)

 

In any case, a Professional subscription is needed. This cannot be achieved in the free CRM or in a Starter portal. If you are on such a subscription, you have to create separate forms to achieve this.
