HubSpot recently updated the following legal documents included in our Customer Terms of Service:

We’ve also made minor drafting clean-ups and clarifications across the terms.

We wanted to give you some information on what's changed below.  Please remember that this is just an informal, high-level summary of the most recent changes to these documents, and that you should always make sure you’ve read and understood the complete Customer Terms of Service before you use our products or services.

General Terms 

  • To avoid doubt, we added express language in the Order Form definition incorporating your Order Form into the Agreement in the ‘Definitions’ section of the General Terms. You’ll see changes consistent with this in the ‘Precedence’ section as well.  
  • We’ve updated the URL at the end of the “Third-Party Products” definition to direct to the now-current webpage.
  • We’ve worked to streamline the definition of Subscription Services to apply broadly unless specifically indicated otherwise in the Product Specific Terms.  You’ll see changes consistent with this in the ‘Subscription Fees’ section as well.   
  • We’ve added the ‘Set Off and Collection’ subsection in the ‘Fees’ section. 
  • In an effort to ease your review, reference to machine learning and artificial intelligence algorithms are now generally referred to as AI models. 

Data Processing Agreement 

  • We updated the URL for the “UK Addendum” in the ‘Definitions’ section of the Data Processing Agreement in an effort to remedy access issues some users may have encountered.  

Sub-Processors Page 

  • In the ‘Feature Specific Sub-Processors’ section you'll see updates for each Sub-Processor on the Sub-Processors Page indicating how their data handling relates to each of the hosting locations we offer.   

Privacy Policy

  • To remain consistent with the General Terms, reference to machine learning and artificial intelligence algorithms are now generally referred to as AI models in the Privacy Policy as well. 
  • We removed a reference to prior dispute resolution processes which have since been sunsetted and replaced with the options available in the Privacy Policy.  

Product Specific Terms 

  • In the ‘Marketing Contacts Products Email Send Limit’ section of the Product Specific Terms, we corrected the reference back to the ‘Fees’ section of the General Terms and removed the sunsetted reference.  
  • In the ‘Commerce Hub’ section, we’ve clarified Stripe payment processing and HubSpot payments are an additional service available outside the scope of our Subscription Services, and are subject to terms and conditions instead of the General Terms. 
  • We’ve made similar updates to the ‘Commerce Hub Fees and Payment’ section, further clarifying some features within Commerce Hub may have separate fees that apply.
