HubSpot recently updated the following legal documents, which are all included in our Customer Terms of Service: 

 

  • September 2, 2022 Product Specific Terms 
  • September 2, 2022 Data Processing Agreement
  • April 7, 2020 Sub-Processors Page 
  • July 19, 2021 Regional Data Hosting Policy
  • September 2, 2022 Jurisdiction Specific Terms 

 

We wanted to give you some information on what's changed below.  Please remember that this is just an informal, high-level summary of the most recent changes to these documents, and that you should always make sure you’ve read and understood the complete Customer Terms of Service before you use our products or services.

 

We’ve also made minor drafting clean-ups and clarifications across the terms.



Product Specific Terms

 

  • We are excited to launch new integration with WhatsApp, and we have updated our Product Specific Terms to include language required for that integration.     
  • We have updated the Other Hubs section to clarify the retrieval language in that section applies to the Other Hubs.  
  • We have updated our support language for starter customers who pay for services to refer to in-app options for support.    

 

 

Data Processing Agreement

 

  • To support some of our new product features and integrations, we have updated our DPA to include more details describing how we use Sub-Processors.  
  • Our List of Subprocessors (previously located within Annex 3 of the DPA) are now listed on their own standalone page as detailed below. These Sub-Processors remain part of Annex 3 of our DPA, and are incorporated into the DPA by reference.

  • Our List of Subprocessors (previously located within Annex 3 of the DPA) are now listed on their own standalone page - the HubSpot Sub-Processor Page! These Sub-Processors remain part of Annex 3 of our DPA, and are incorporated into the DPA by reference.
  • You will also notice we have separated the Sub-Processors into different tables based on what support they provide.



Regional Data Hosting Policy 

 

  • To support the new WhatsApp integration, we have updated our Regional Data Hosting Policy to include Meta in the exception table.  
  • We made additional changes to the exception table in an effort to clarify if and how you can avoid certain Sub-Processors accessing your Customer Data.
  • We also updated the Regional Data Hosting Policy to remove language regarding hashed synced data storage.
