HubSpot recently updated the following legal documents, which are all included in our Customer Terms of Service:

We’ve also made minor drafting clean-ups and clarifications across the terms.
Additionally, HubSpot recently updated the following documents that may apply to your use of our services or websites, which we are including here for your convenience.

 

We wanted to give you some information on what's changed below. Please remember that this is just an informal, high-level summary of the most recent changes to these documents, and that you should always make sure you’ve read and understood the complete Customer Terms of Service before you use our products or services.

General Terms

  • The definition of ‘Subscription Term’ now reflects additional detail (e.g., distinguishing between an Initial Term and Renewal Term, etc.). You’ll see updates consistent with this additional detail throughout the document.
  • The definition of ‘Confidential Information’ now expressly includes information from Affiliates of the Disclosing Party.
  • We updated the language in the ‘Payment Against Invoice’ section in an effort to make it easier to read, but we kept the payment and invoicing timelines the same.
  • We updated the ‘Confidentiality’ section to generally allow for disclosure of Confidential Information for Partner Program purposes to HubSpot Solutions Partners who are bound by confidentiality obligations.

Product Specific Terms

  • HubSpot launched a seats-based pricing model designed to provide flexible subscription options that scale with businesses, so you’ll see the new ‘HubSpot Seats’ section in the Product Specific Terms. You can learn more about HubSpot Seats on our product page: Introducing HubSpot's New Pricing Model. You’ll also see updates consistent with this change throughout the terms.
  • We added a ‘Texting’ subsection under the Other Services header, so we removed the ‘SMS for Marketers’ subsection under the Marketing Hub header.
  • We added information about the YouTube API services in the ‘YouTube Integration’ section.
  • In the ‘Other Hubs’ section, we removed the reference to our current Hub services. As a reminder, you can find details related to our current services in the Product and Services Catalog.
  • Similarly, we updated the ‘Customer Support’ section to refer to the Product and Services Catalog for service-specific support information.
  • In the ‘Phone Support’ section, we clarified support hours may be limited during recognized holidays applicable to each of our entity locations.

Acceptable Use Policy

  • The previously titled ‘Telephone and SMS Marketing’ section, is now titled ‘Telephone, Texting, and Messaging’ in the Acceptable Use Policy.
  • We updated the language related to HubSpot supported communications in an effort to provide more clarity to users about acceptable use and compliance obligations.

Stripe Payment Processing Terms

  • We are excited for our global launch of HubSpot Stripe payment processing! As a reminder, the terms applicable to Stripe payment processing are available at https://legal.hubspot.com/stripe-payment-processing-terms.
  • This page reflects our global launch by removing location restrictions and beta tags.  Please note, these terms apply only if you use Stripe payment processing; we are letting you know here given this is a new, globally-available service.  

Sub-Processors Page

  • To support the global launch of HubSpot Stripe Payment Processing, we updated the Sub-Processor Page to include Stripe, Inc. as a payment processor for customers who choose to use Commerce Hub products and services.

Regional Data Hosting Policy

  • Similarly, to support the global launch of HubSpot Stripe Payment Processing, we updated the Regional Data Hosting Policy to include Stripe, Inc. as a payment processor in the United States for customers who choose to use Commerce Hub products and services.

Jurisdiction Specific Terms

  • We updated the Jurisdiction Specific Terms to clarify the “Company Address” field in your HubSpot Account is associated with your physical address.

Checkout Terms of Service

  • We updated our Checkout Terms of Service to provide more information on what buyers are authorizing with respect to their data and payments when they use our B2B checkout experience.

HubSpot Payments Terms of Use

  • We updated our HubSpot Payments Terms of Use to clarify that these terms continue to apply when you resume use of HubSpot payments or your HubSpot payments account.

EU Digital Services Act

  • We updated our DSA page to reflect the reporting process we support.

Affiliate Program Agreement

  • We updated our company address.

App Partner Program Agreement

  • We updated the Marketplace Terms of Use URL and removed outdated references.
  • We updated the ‘Confidentiality’ section to include additional details.
  • We refined the language in the ‘Termination’ section in an effort to make the section easier to read.

Certified Trainer Program Agreement

  • We updated our company address.

Education Partner Agreement

  • We updated our company address and the contact information for compliance questions or concerns.

HubSpot Developer Terms

  • We updated our company address and the notice recipient information.

HubSpot for Startups Partner Co-Marketing Addendum

  • We updated our company address.
