We wanted to give you some information on what's changed below. Please remember that this is just an informal, high-level summary of the most recent changes to these documents, and that you should always make sure you’ve read and understood the complete Customer Terms of Service before you use our products or services.
We’re excited to launch HubSpot Credits! We've updated the General Terms ‘Fees’ section to include references to new HubSpot Credits.
We worked to refine the ‘Entire Agreement’ section by clarifying applicable Orders are included.
Product Specific Terms
The new ‘HubSpot Platform Access’ section in theProduct Specific Terms includes the existing HubSpot Seats information and the new HubSpot Credits details.
You can now use HubSpot Credits to engage with our Enrichment Products. As a reminder, using Breeze Intelligence tools in HubSpot (Enrichment, Intent, Smart Properties, Data Tests, and similar features), is subject to the ‘Enrichment Products’ section of the Product Specific Terms and throughout the Agreement.
The ‘AI Products’ section is now ‘Generative AI’, and you’ll see that reference updated throughout the terms.
The ‘Call Recording’ section is now ‘Recording of Calls and Other Electronic Communications’, and we’ve updated the section to reflect use and compliance obligations.
Data Processing Agreement
We updated the ‘Transfer Mechanisms’ section of the Data Processing Agreement to have the Standard Contractual Clauses apply, in addition to the Data Privacy Framework.
Sub-Processors Page
We’ve updated the ‘Feature Specific Sub-Processors’ section of the Sub-Processors Page as follows:
We simplified the Applicable Service descriptions throughout the page.
As described in the Product Specific Terms summary, we updated references to “Generative AI” from “AI Products” to align with other updates across our terms.
We simplified the subprocessing details to more easily identify reCAPTCHA and added Speech to Text to support calling and transcription being enabled for most customers using call recording.
We’ve removed duplicative language from the table indicating features may be optional. Any optional Sub-Processors are already marked on the page with an asterisk indicating you may choose not to use the functionality provided by our Sub-Processors.
Privacy Policy
We refined the ‘Partners’ section of the Privacy Policy to clarify the purposes for data processing applicable to HubSpot partners.
We’ve added a new section, ‘HubSpot Marketplace,’ to describe how personal information may be processed when using a HubSpot Marketplace.
We updated the 'Data Privacy Framework Notice' section to include our commitment to cooperate with relevant data protection authorities regarding unresolved complaints about personal data handled under the Data Privacy Framework.
In the ‘Google Products And Integrations’ section, we moved resources to learn more to the top of the section for ease of reference.
We added a new ‘Google Speech to Text’ section to describe how Customer Data may be used to provide features within our services.

We've incorporated the new Optional Partner Program, Pilot and Beta Specific Terms in an effort to make information about specialized partner programs easier to review. We've moved this content from the previous Partner Jurisdiction Specific Terms, which has been retired.
We’ve unified the effective date and the “Last Modified” date at the top of the page.
We've updated the 'Assignment' section to include clearer instructions to you in this event, such as a 30-day advance written notice of proposed mergers, reorganizations, or other significant corporate transactions, a clear path to provide notice and our commitment to provide reasonable support accommodations when proper notice is given and consent is granted.
HubSpot Business Partner Data Processing Agreement
We've added a new table of contents, updated section titles, and renumbered sections throughout the Business Partner Data Processing Agreement in an effort to ease your review.
We’ve updated ‘Schedule A’ as follows:
The 'Categories of Data Subjects' and 'Categories of Personal Data' sections now expressly include prospects and clarify data importer and data exporter roles.
The 'Nature and purpose of the processing' section now reflects obligations under the Partner Agreement and obligations under applicable law.
HubSpot App Partner Program Agreement
We’ve added a new table of contents to the App Partner Program Agreement along with updated section headers and numbering throughout the document in an effort to ease your review.
