HubSpot recently updated the following legal documents, which are all included in our Customer Terms of Service:

Additionally, HubSpot also recently updated the following documents, which we are including here for your convenience that may apply to your use of our services or websites:

 

We wanted to give you some information on what's changed below.  Please remember that this is just an informal, high-level summary of the most recent changes to these documents, and that you should always make sure you’ve read and understood the complete Customer Terms of Service before you use our products or services.

 

We’ve also made minor drafting clean-ups and clarifications across the terms.

General Terms 

  • We updated the Unauthorized Use section of the General Terms to include a prohibition on reverse engineering 
  • We included information about HubSpot and the European Union Digital Services Act of 2024 at https://legal.hubspot.com/digital-services-act for your information    

Jurisdiction Specific Terms 

  • We included titles for Section 1 (Contracting Entity; Applicable Law; Additional Terms) and Section 2 (Other Locations) for ease of reference 

Product Specific Terms  

  • We updated the name of our CRM to "Smart CRM" to reflect the updates we have made to our CRM features
  • We included an additional knowledge base article for convenient access to instructions regarding data deletion, including GDPR deletes  
  • We updated the YouTube integration section, including links to YouTube terms 
  • We clarified the Platform Fee language in an effort to avoid ambiguity 
  • The AI Products section now includes a link to the Product Specific Terms | HubSpot AI Products FAQ page for  convenience

Data Processing Agreement   

  • We included an additional knowledge base article for convenient access to instructions regarding data deletion, including GDPR deletes  
  • We clarified customers are acting in the capacity of a data controller, either on their own behalf or on behalf of another data controller under the DPA

Subprocessors Page    

  • We updated the Feature Specific Subprocessor table to reflect Google supporting B2B Checkout spam prevention
  • The Updates to This Page section now reflects our practice to update Customers in the event there is a change to the location or the nature of the services a data processor may provide 

Regional Data Hosting Policy     

  • We worked to make the page easier to navigate by alphabetizing the table 
  • We updated the Third Party Subprocessor table to reflect Google supporting B2B Checkout spam prevention

Privacy Policy     

  • We updated the YouTube integration section, including links to YouTube terms and including a link to a knowledge base article reflecting instructions on how to Remove access to HubSpot in your Google account
  • We made some changes to the HubSpot Partners section, including our co-marketing form for more information 
  • We use the SCCs as the mechanism to transfer data for our internal transfers from the European Economic Area to the United States, as reflected in the  How We Transfer Personal Data Internationally section of the Privacy Policy
  • We use the DPF as the mechanism to transfer data on behalf of our customers, as reflected in our DPA, and the Data Privacy Framework Notice section of the Privacy Policy was updated 

Acceptable Use Policy    

  • We included information about HubSpot and the European Union Digital Services Act of 2024 at https://legal.hubspot.com/digital-services-act for your information 
  • We removed language regarding compelled disclosure of confidential information, which is already addressed under our Customer Terms of Service and our Privacy Policy 

Payments Terms of Use    

  • For customers who use HubSpot payments products, we updated the Verification and Underwriting section to include a requirements for you to review information to ensure its accuracy
