One-to-one Sales emails also need to comply to CAN-SPAM

According to the FTC CAN-SPAM docs, Sales emails sent individually through the HubSpot platform should be CAN-SPAM compliant - https://www.ftc.gov/tips-advice/business-center/guidance/can-spam-act-compliance-guide-business.

 

If an email contains "Commercial content which advertises or promotes a commercial product or service, including content on a website operated for a commercial purpose;", it must comply with CAN-SPAM laws, especially if these emails are "cold emails", specifically meaning the sender has not established a prior relationship with the recipient. There shouldn't necessarily be an unsubscribe link because HubSpot is not providing a bulk email service through Sales emails, but there must be "a clear and conspicuous explanation of how the recipient can opt out of getting email from the sender in the future."

 

Maybe this looks like an uneditable CAN-SPAM compliance token embedded in every template saying something like:

{If you no longer want to receive emails from me, please reply to this email with "unsubscribe" in the email body}

 

Regardless of how this ultimately looks, HubSpot should develop a resolution to this issue to help HubSpot Sales customers to comply with CAN-SPAM since many are small or independent salespeople being threatened in some cases with hefty fines.
