Whitepaper download with DOI and marketing consent

Hello together, 

we would like to offer a whitepaper download on our landingpages. In addition, we would like to include the option for a marketing consent with a checkbox. As far as I know, we need a seperate marketing consent in addition. If it is not given, we are only allowed to send the whitepaper and no other marketing emails afterwards.

 

Therefore, two possibilities should exist:

#1 Lead fills in the form without marketing consent checkbox, gets a DOI mail and receives a follow up mail with the link to the whitepaper. No marketing consent is created.

 

#2 Lead fills in the form and checks the marketing consent checkbox, gets a DOI mail and receives a follow up mail with the link to the whitepaper. The marketing consent is created.

 

I created the form and also included the checkbox choosing the GDPR option "Consent checkbox for communications; form submit as consent to process" and in addition I turned of the setting "Set contacts created as marketing contacts". I was hoping that only when checking the GDPR option consent checkbox that the marketing consent would be created, bit it does not work?!

 

After doing an extensive research, I didnt find any solution on how to implement it in a GDPR confirm way. Could anyone help me out?

This is where things get a big confusing. Marketing contacts are a licensing feature, telling HubSpot whether they should count toward your billable contacts. This doesn't matter when it comes to the legal basis of communication.

 

When someone submits your form and checks the communications checkbox, that is linked to one of your subscriptions types. This will be then set from empty to "Opt-in" for this particular subscription type. HubSpot doesn't work with a general marketing consent but only with specific subscription types.

 

To summarize:

  • When submitting the form, the contact's legal basis for processing their data is updated automatically.
  • If they check the communication box, they will have the value "Opt-in" for that particular subscription, usually the subscription type "Marketing".
  • Marketing contacts are a feature for billing. This is a must for sending emails but does not have any GDPR aspect.
  • Once the double opt-in email is sent and clicked, the property Marketing email confirmation status is updated to "User clicked confirmation".
