Disabling GDPR and Double Opt in for non GDPR contacts

Hello, 

We have one HubSpot account that works across borders, is fully international and is not Sales Hub set up - only Marketing Hub enterprise. Previously, our US Sales team were adding basic leads to Salesforce, which then synced as marketing contacts into HubSpot for the US marketer to nurture further.

 

However, we have GDPR and double opt in enabled. As these US leads sync as marketing contacts but do not have any subscription type, or have ever opted in, there is a high failed to send error/NDR.

How do we regionalise our account, to protect our EU data, but to also enable us to opt in those who are based in non GDPR countries.

Would it be ok to opt these in bypassing GDPR with a workflow that simply assigns a subscription type, and assigning legal basis as not applicable, and also ensuring they do not receive the double opt in emails?

Hey @PBMEB360 there's actually a setting in the account to stop sending any emails to contacts who do not have the appropriate GDPR consent. This is under settings > privacy and consent.

If this is disabled then you can still email contacts who do not have the consent options, even if GDPR is enabled in your portal. 
This may however open you up to potential danger if all of your contacts in GDPR countries don't have fully up to date subscriptions (you may accidentally email them without a subscription type). 

At the moment there's no localised specific settings to say only apply certain rules to certain contacts, the GDPR options are account wide. 

One workaround you could use it auto-opting any contacts from non-GDPR countries into a subscription type (legitimate interest would make sense but it's up to you!) 
You can do this through workflows, you could set something like this, which enrolls contacts who are in America and opts them into marketing subscriptions via legitimate interest.

Hey @PBMEB360 it means someone who has not given legal consent to be emailed could be emailed from your HubSpot platform without that opt-in status yes! It's entirely possible you could accidentally breach GDPR with it, but I'd check with your legal team to clarify the full extent on that. 

You could create a list to check how many contacts could be at risk here too. Something like this which would show all contacts in these countries who do not have opted in subscriptions:

Thanks Tom - I'm not wholly confident in the data at this business, so have been using double opt in and legal basis as a way to counteract the bad data they have accrued over the years.
If I disable legal basis for email, does that mean potentially if we don't know if someone has opted in previously, opted out, or is based in Germany, then we could potentially breach law? Just want to make sure as my CMO is keen to just turn every setting off so the US team can mass mail out!

Would Business Unit Add On also solve the issue?
