Are my resellers considered marketing contacts?

SOLVE

Hey, I am new to Hubspot and my company is currently switching from our existing CRM to Hubspot. We are a manufacturer and are going to use the Marketing Hub. I am trying to figure out if all of our resellers would fall under "marketing contacts". We don't actually send them marketing email blasts, like we do to end users of our products. But we do send them mass emails updating them on our pricing or any discounts they can pass on to thier customers, instead of sending each reseller a one-to-one email. I am just unclear if that would fall under the transactional type of email...

I just want to make sure we are following laws and rules.

Hi @JScharpe,

 

Whether these emails are considered transactional email is a legal question that your legal team or a legal professional al should weigh in on. Unless however the resellers signed a contract and it's part of that contract that they receive contractual updates, email updates typically aren't - but a professional can make the final call here. (My reply does not constitute legal advice.)

 

If the emails are considered transactional, no marketing contact status is needed. If they are regular bulk email sends, the resellers would have to be marketing contacts.

@JScharpe With HubSpot, marketing contacts aren't defined by whether you're marketing to the contact with "email blasts" or sending mass updates. 

 

The definition of a marketing contact is a contact that will receive emails via the Marketing Emails tool. If you want to be able to send emails to them via a list and not 1:1 then they need to be a Marketing Contact.

 

With that said, you'll want to configure different subscription types for each type of marketing email you plan to send (there should be a dedicated subscription type for Resellers so they still have the chance to opt-out).
