Double optin & GDPR consent for German companies

Hello,

 

I have a client who needs to set up double optin (on Hub Marketing Pro) for his German branch.

 

We have tested the functionality and one thing caught our attention. When double optin is active, if I fill out a form and don't check the consent box, I still receive the double optin confirmation email.

 

If there are users in Germany, does this make sense to you and if not, how do you handle double optin on your HubSpot portals?

Before I begin a short disclaimer: This post does not constitute legal advice. When in doubt, you should always discuss with a legal expert.

 

The double opt-in is the process of confirming an email address, not the process of confirming consent. The assumption here is that the person needs to confirm that it was them who submitted the form and not a third party. This confirmation of the email address is not necessarily related to any consent into further marketing communication.

 

Let's assume a simple contact request form. No marketing consent is needed to handle this request. If a double opt-in is required in a country and for this use case, then the contact would still have to confirm their email address before the request could be handled. All of this would not have anything to do with additional marketing consent.
