We’ve also made minor drafting clean-ups and clarifications across the terms.

We wanted to give you some information on what’s changed below. Please remember that this is just an informal, high-level summary of the most recent changes to these documents, and that you should always make sure you’ve read and understood the complete Customer Terms of Service before you use our products or services.

____________________________________________________

General Terms

  • We’ve updated the General Terms to reflect ‘Revenue Hub’ as the new name for what was previously “Commerce Hub” and applied this change throughout the Agreement.

  • We’ve updated the definition of “Overages” to reflect Pay-as-You-Go as the new default for when you exceed your HubSpot Credits Limit.

  • For customers who subscribe under the AWS TOS AWS Marketplace HubSpot Customer Terms of Service, the ‘Term and Renewal’ section now indicates that term information will be detailed in the order documentation you authorize at checkout.

Product Specific Terms

  • We’ve updated the Product Specific Terms to reflect ‘Revenue Hub’ as the new name for what was previously “Commerce Hub”.

  • In the ‘HubSpot Credits’ section, you’ll see Pay-as-You-Go is now the default setting after adding HubSpot Credits, and we’ve also worked to simplify the language in this section with the aim to ease and enhance comprehension.

  • We’ve added a new ‘AI Agents’ provision section to the ‘HubSpot AI’ section, which sets out your responsibilities for AI Agents, including authorizing their access to data and systems, supervising their actions, disclosing automated interactions to your end users where required by applicable law, and ensuring they are not used for purposes prohibited by applicable law.

  • The ‘Recording of Calls and Other Electronic Communications’ section has been renamed to 'Recording of Calls and Notetaker’ where you will also find additional updates reflecting new Notetaker functionality.

Data Processing Agreement

  • The Data Processing Agreement updates are limited to the changes reflected in the Sub-Processor Page incorporated into the DPA and summarized in the SubProcessor Page section of this post.

Sub-Processors Page

  • We’ve added three new Sub-Processors to the Sub-Processors Page list: Baseten Labs, Inc., Bright Data Ltd., and Exa Labs, Inc.

  • We’ve also updated references to Revenue Hub (previously Commerce Hub) on the page.

Privacy Policy

  • In the Privacy Policy, we’ve clarified we use Google reCAPTCHA across our websites and products for security, fraud, and abuse prevention.

  • You’ll see a new ‘Google Map Integration’ section describing how HubSpot uses autocompletion and validation features in our products and services.

  • We’ve also added a new ‘YouTube API Limits’ subsection indicating HubSpot’s compliance with YouTube API Services Developer Policies.

Acceptable Use Policy

  • The ‘Prohibited Acts’ section of the Acceptable Use Policy now includes prohibited acts for AI Agents.

Payments Terms of Use

  • We’ve added the ‘Additional Payment Processor Services’ section to the Payment Terms of Use. HubSpot may occasionally directly offer the financial products or services of payment processors (like lending or credit) through HubSpot’s other services. Any such offerings are governed and underwritten by payment processor terms. HubSpot’s role is to surface access to those products through our platform, not to be a party to them, and not to make any promises about whether you’ll qualify.

  • We have made numbering, formatting, and capitalization updates throughout to align with our other terms.

Stripe Payment Processing Terms

  • We’ve added the ‘Additional Payment Processor Services’ section to the Stripe Payment Processing Terms. HubSpot may occasionally directly offer Stripe’s financial products or services (like lending or credit) directly through HubSpot’s other services. If and when that happens, those offerings are Stripe’s — governed by Stripe’s terms, underwritten by Stripe or its partners. HubSpot’s role is to surface access to those products through our platform, not to be a party to them, and not to make any promises about whether you’ll qualify.

  • We have made numbering, formatting, and capitalization updates throughout to align with our other terms.

Flexible Seats-and-Credits Terms

  • The HubSpot Flexible Seats-and-Credits Terms apply when they are included in an Order Form. HubSpot Flexible Seats-and-Credits Terms replace previous pilot programs, including the HubSpot Limited Release Pricing program or the Nordic Region Limited Release program. You’ll see the HubSpot Limited Release Pricing Terms updated to reflect the new name.
