Yes - The new tracking consent record will govern both marketing and one to one email tracking.

None of these tools will be removed or changed, but if you’ve opted into consent based tracking then recipients who have revoked consent will not have data represented in these tools. Hope this helps!

Open/click distinction: If opted into our new consent tracking feature then the consent-to-track property will govern both open and click tracking. This means when a contact hasn’t consented, neither opens nor clicks will be tracked.

Per-brand storage: Yes - open and click data is already stored at the brand level and filtered based on which brand you’re logged into, so that behavior is consistent with how subscription types work today.

The law has now been passed in France, and we need to ensure compliance with email tracking. Currently, the lack of this feature is adding a significant extra burden for us. Do you have a product update date you can share with us?

Hi, thanks for your input. So basically HubSpot has no plans to differentiate open and click tracking like Mailchimp is currently doing?

I’m also referring to consent per brand. Will there be a subscription type per brand which captures this new type of consent?

Re open vs. click tracking - I can’t speak to Mailchimp’s product, but today we have portal-wide toggles for each as well as a per-email toggle to turn both off for a specific send. One thing worth noting is that while click tracking is its own setting, it’s only available when open tracking is on (since a click implies an open). Is your question whether you can have click tracking on while open tracking is off? If so, the answer is no. We require open tracking to be on for click tracking, and if you’re opted into consent-based tracking the consent record will govern both. If you have feedback here we’d love to hear it!

On brand-level consent - that’s something we’re actively evaluating as part of this work. Happy to follow up once we have more clarity there.
