Thank you for the update and your efforts. We are impatiently awaiting a native solution from Hubspot. Managing this issue manually is incredibly time consuming and we are very disappointed they were not proactive in addressing this as we have all known it was coming for quite a while.

One matching idea I already raised to my Customer Success Manager:
Please set the new “Email Tracking off” possibilities up a way that there are still KPIs for Marketing Emails available in the overview if is switched if OFF for inside an Email. But obviously the figures should only be on high level without a deep dive into details on contact level. That should fit the new requirements in France/Italy as it is statistical and not personal.

…everyone looks on KPIs these days and no one of us is likely to send out emails without any overall performance/success measures. That would feel like sending out old school post letters :woozy_face:

Thanks to the HS team for moving quickly on the Email Tracking Toggle to get that live so quickly. That gave many of us a way to reduce our compliance risk immediately.

That said, HubSpot needs to move just as quickly on a contact-level solution.

Many of us support enterprise organizations operating globally. France is already in effect, Italy is next, and we’re having to implement interim processes now that we know we’ll eventually need to unwind.

We’ve already created duplicate emails, duplicate workflow branches, exclusion lists, and country-specific logic simply because there isn’t a way to suppress tracking for individual contacts while still sending the same email asset.

A native contact-level tracking preference that allows HubSpot to dynamically remove the tracking pixel (and eventually click tracking, if required) during send would eliminate a tremendous amount of complexity.

One request I’d add to the design process:
Please support migration from existing custom properties.

I’m sure we are not the only ones building our own “Email Tracking Consent” properties to begin collecting consent now. If HubSpot ultimately introduces a native property, allowing us to map our existing values into the new system would save hundreds of hours across enterprise portals.

There are already several ESPs that have implemented similar functionality and may provide useful reference models for the product team:

  • Brevo: Contact-level tracking consent, preference center integration, and separate management of marketing consent versus tracking consent.
  • ActiveTrail: Dedicated tracking consent field, tracking preference page, API support, and dynamic suppression of tracking for contacts who opt out.
  • MoEngage: Guidance and consent architecture designed around the new CNIL and Garante requirements, including separate consent management and granular withdrawal.

This challenge is no longer theoretical. Many of us have already or are actively redesigning production workflows to remain compliant, and every interim solution we build today is one we’ll have to revisit (read as tear down) later.

A scalable native solution (that includes a migration path from the custom work happening now) would make a tremendous difference. :vulcan_salute:

I am currently working with HubSpot for our marketing and sales operations, and I am facing a compliance challenge regarding tracking pixels in emails (both marketing and one-to-one sales emails).

The Problem: Under stricter privacy regulations (such as GDPR in Europe), tracking email opens and clicks via pixels requires individual user consent. Currently, HubSpot manages tracking globally (at the account level) or per asset (at the email level). There is no native way to manage tracking pixels dynamically at the individual contact level based on each user’s personal preferences (for example: if a contact opts out of tracking in their preference center, we cannot automatically strip the tracking pixel from their emails while still allowing them to continue receiving the message).

Feature Request / Product Update Idea: We would love to see HubSpot develop a native feature allowing:

  • Contact-level tracking preferences: A property or preference flag that determines whether tracking pixels (opens/clicks) should be injected or not into an email for a specific recipient.

  • Dynamic injection: The automatic omission of tracking pixels for contacts who have opted out of tracking, while maintaining email deliverability.

Hi everyone - My name is Jackie Brenna, and I am a Product Manager on HubSpot’s Email Platform team. First, I want to thank you all for taking the time to share your feedback. It directly influences how we prioritize our work!

I’m happy to share that we are actively building a consent-based tracking solution. The plan is a new “track by consent” option that introduces a new email address consent record that will govern whether a tracking pixel is inserted at send time - no manual action required on a per-campaign basis. The property will store the metadata required for compliance (timestamp, consent source, method of collection) and will be the source of truth the backend evaluates at the moment of send.

We’re still in the scoping phase, so I can’t commit to a delivery timeline yet, but this is a top priority and we’re moving on it. In the meantime, keep the feedback coming - I’ll be monitoring this thread closely and will post updates as possible. Thanks!

  1. Will there be a distinction between open and click tracking?

    Our regulations let us send marketing emails for up to two years after the last open or click date. Being able to see the date of each action helps us prove we’re compliant if audited.

    Opens and clicks show different levels of engagement. Tracking them separately helps us spot which contacts are healthy and active, improve targeting, and keep our data clean.

  2. Is this open and click tracking stored per Brand/Business Units (similar as the Subscription types)? We have 18 Brands in HubSpot (each with their own subscription type).
