Meta Lead Ads: Trigger Double Opt-In ONLY for contacts who check optional marketing box

Hi everyone,

Looking for guidance on setting up Meta Lead Ads with HubSpot to stay compliant with EU data privacy laws.

Our Setup & Legal Basis

Our Meta form has two distinct fields:

  1. Mandatory Processing Consent: Required to submit the form and receive the requested resource.

  2. Optional Marketing Checkbox: An unticked box for newsletter subscription.

European Legal Basis (GDPR Art. 6 & 7 / ePrivacy): Consent must be unbundled and freely given. Only users who actively check the optional box grant explicit consent for marketing. Sending a Double Opt-In (DOI) or marketing email to someone who leaves the box unchecked violates GDPR consent principles regarding unsolicited communications.

What We Need in HubSpot

  • Send a Double Opt-In email ONLY to form submitters who checked the optional marketing consent box.

  • Do NOT send the DOI email to all Meta form submitters across the board. Submitters who skip the box should only get transactional content delivery, with no marketing opt-in emails triggered.

My Question:

What is the best way to configure this conditional DOI in HubSpot (e.g., via Workflows mapped to Meta consent fields vs. account subscription settings)?

This is currently not possible with the native, default HubSpot double opt-in. The settings can’t be adjusted to trigger only under specific conditions like a custom property value being known.

As of now, the only way to solve this - as far as I know - requires a fully custom double opt-in set-up. High-level, these are the steps:

  • Enable system double opt-in, effectively disable it by limiting it to an unused page
  • Create custom automated emails with the subscription confirmation link
  • Create a contact-based workflow which triggers the custom automation emails based on your custom property passed over from LinkedIn

Ideally, the custom automated emails are sent with the transactional email add-on.

I’ve had the idea of creating a custom automated email for the DOI issue as well. After creating it and publishing in the Email tool, Hubspot marked it as “This email content may violate our Terms of Service and can’t be viewed”, and blocked me from being able to further edit or use it. This status hasn’t cleared from this email for the past 2 days, so I am guessing their verdict is final - creating a custom automated emails with the subscription confirmation link is breaking GDPR European laws.

Can I ask you if you set it up for organizations that are located in the EU? Or we’re you successful with this only for US clients?

Perhaps I am missing a piece of content in the email that can prevent from Hubspot to block this email for legal reasons, so your advice is much appreciated.

@Anat.Gilaad the violation notice is strange, I haven’t seen that in more than a decade of configuring double opt-in emails for my clients. If this persists with other custom emails, that’d be a case to discuss with support. It may be a certain keyword in the email that triggered the process.

That should not be the case, no. There is a dedicated link type for this out of the box so it must be something else.
