Marketing Contact or Transactional emails

We often run campaigns where we ask users to sign up via a form for a specific issue. We then only contact the user when the issues is resolved and are no longer sent any further communication.

If we set these contacts as a “marketing contact” this uses up our marketing contact limits.

In this case should we set these contacts as non marketing but send the email subscription type as Transactional?

Hi @RM88,

Emails sent with the transactional email add-on from HubSpot don’t require the marketing contact status, correct, so that could be a good option here.

If the emails you’re sending are purely to fulfill something that was explicitly requested, legal teams usually say that the request itself constitutes a legal basis to send emails.

This reply is not legal advice so you should always check with your legal team. From what you’re describing it sounds like those emails can be sent as transactional – in which case you wouldn’t have to mark them as marketing contacts.

Best regards!

Hi @RM88

If your intention is to only contact users when a specific issue is resolved and you do not plan on sending them any further marketing communication, it would be more appropriate to categorize these contacts as non-marketing.

Setting these contacts as non-marketing ensures that they do not count towards your marketing contact limits. However, you can still utilize transactional emails to communicate with these users. Transactional emails are typically used for delivering information that is directly related to a user’s interaction or transaction with your organization, such as order confirmations, password resets, or in your case, updates on issue resolutions.

By setting the email subscription type as transactional, you can maintain a clear distinction between your marketing emails and the specific issue-related updates you are sending. This way, you can effectively manage your marketing contact limits while keeping users informed about the progress on their reported issues.
