How can we track and prove sending a "legally sensitive" email that the receiver "opens & reads" it?

How can we track and prove sending a “legally sensitive” email that the receiver “opens & reads” it? FYI: The sender must have official confirmation, record and provide proof that the receiver received the email, so the sender can provide the proof that the receiver received the email in court or for a legal case. Therefore, the email tracking function must provide proof that the receiver “opened and read” the email at their end. Email tracker function must provide a report - who opened, what date, what time etc.

Hi @T-LegalEmail,

There is no dedicated feature for this in HubSpot. If the recipient side is configured to not load any images, for example, you wouldn’t see if they opened an email or not. You can prove that the email was sent, but not that it was opened and read. Even if it shows as opened, there’s a good chance that this was a bot open and not an intentional read by the human recipient.

Honestly, I don’t think this exists, neither in HubSpot nor with other tools -- unless you include or find a mechanism where recipients confirm the receipt. Email tracking cannot prove who opened an email, only that an email was opened (most likely). In HubSpot you’ll see date and time of an open on the individual contact record, if tracking works as expected.

Best regards
