Form Check Box vs Double Opt In

1 - We created a form with a 'Data privacy and consent" checkbox.

How do we know if a contact checked the box? We do not see an indication in the form analytics. Is there a contact field that would note this 'concent?"

2 - We also turned on Double Opt In for forms.

Is this over kill?

If you went with the default form consent options, HubSpot will save that information in two places:

  • The legal basis for data processing is stored in the contact field “Legal basis for processing contact’s data”, which you can find by clicking “View all properties” in the left sidebar of a contact record.
  • The legal basis for communication (e.g. whether a contact checked a subscription box in your form) can be found by following these steps: Manage your contacts' messaging subscriptions

This depends entirely on the legal requirements in the countries you’re doing business in. I have many customers with extensive consent texts in forms and strict double opt-in and I have customers with surprisingly short consent texts and no double opt-in. This decision is typically either made by the legal team, an external legal consultant or simply by executives who weigh the risk of losing contacts due to these settings against fines.
