With the new email tracking pixel rules, Is there any way to handle email tracking for new contacts when their tracking preference is not yet known? And Is there any way in HubSpot to disable email tracking at the contact level, So this avoids sending separate emails to contacts who have opted in and those who have opted out of tracking.

As of now, no, HubSpot has not shared any plans. Many users have however already requested this here: Allow per-contact control of email open & click tracking (re: France & Italy compliance)
Requests like these are reviewed by the product team based on their popularity. You can help with that and also direct other users to the request by accepting my reply as a solution. I’d appreciate it, too.
Until then, you would have to make sure that tracking is disabled for emails that are being sent to contacts without tracking consent. This can mean that you have to create each email twice - one version that is tracked, one that isn’t - and use workflow branching to send the right version.

Any update on a planned fix by Hubspot? The double asset solution is NOT an acceptable solution for this - it didn’t just happen overnight.

I understand that maintaining duplicate assets isn’t a workable long-term solution.

) " Allow per-contact control of email open & click tracking (re: France & Italy compliance) ", I’m glad to see that it is now in Development!
Here is the latest update from our Product Team:
"I’m happy to share that we are actively building a consent-based tracking solution. The plan is a new “track by consent” option that introduces a new email address consent record that will govern whether a tracking pixel is inserted at send time - no manual action required on a per-campaign basis. The property will store the metadata required for compliance (timestamp, consent source, method of collection) and will be the source of truth the backend evaluates at the moment of send.
We’re still in the scoping phase, so I can’t commit to a delivery timeline yet, but this is a top priority and we’re moving on it. In the meantime, keep the feedback coming - I’ll be monitoring this thread closely and will post updates as possible. Thanks!"
