Double Opt In what happens if they do not accept link?

Hi all,

I have two questions regarding the double opt in feature in Hubspot.

If we have double opt in feature enabled, what happens to the contact record if they do not click subscribe to marketing communications (but have consented to processing their data in our database in a second checkbox) - do they receive a double opt in email to confirm their opt in status? I assume not but just want to be sure.
Also, if the user subscribes to both marketing communications and consented to their personal data, and gets sent a double opt in email to their email address to confirm their opt in status, what happens if they decide to not interact witht the double opt in email (therefore not confirming their opt in status) and decide to just delete that double opt in email. Would they still be stored in our database (as they have consented to the processing of their data) and what would happen to the marketing status (as they have decided to not interact with the double opt in) - is there a chance I could accidentally send a marketing newsletter to them even though their double opt in status was not confirmed?
I just want to be 100% sure on this!

The double opt-in email is sent, regardless of whether a subscription checkbox has been ticked or not. The double opt-in documents whether a contact’s email address is confirmed or not – not whether the person gave consent or not. To bypass this, you would need contact-based workflows and a hybrid setup, using workflows to trigger double opt-in emails only under certain circumstances.

Regarding your second question, HubSpot does not delete unconfirmed contacts automatically. That’s something you’d have to look into yourself, by filtering for contacts where the Marketing email confirmation status is neither “Customer marked confirmed” nor “User clicked confirmation”. Personally, I like to create an active lists with these criteria exactly to suppress from all marketing communication to be 100% sure.

Generally however, When double opt-in is enabled, contacts who have not confirmed opt-in will be dropped from any marketing emails that do not include a subscription confirmation link. You can see the full effects of the double opt-in setting here.

So just to confirm the double opt in email is sent to all contacts not just contacts that subscribe to marketing newsletters?

If the marketing contact does not confirm through the double opt in, we cannot legally send them newsletters until that double opt on is confirmed? And we can manage this through the active list filters (yay love active lists!)

If the contact consents to the processing of their data (mandatory in our forms) but does not confirm through double opt in, would we be able to process their data? Or can we send them an email saying “Hey you haven’t confirmed your email through double opt in, please click here if you are happy for us to process your data”? note this is for consent only and not contractual/legitimate interest.

It would be a lot easier if we had the workflows option but we only have the starter marketing hub package so it is not included unfortunately.

Yes, you can also test this with a form submissions yourself; fresh email addresses, one with consent to communicate box checked, one unchecked.

That depends on where you’re doing business and specific legal requirements for your what you’re doing. I’d always recommend double checking with a legal professional if you haven’t done so yet.

The data are being processed anyway, with the form submission. Since the double opt-in email is sent after the form submission, there is no space in between where HubSpot holds the contact information until it is confirmed. The contact is created in the moment of the form submission. If the contact does not confirm, it would be your obligation to manage these contacts and potentially delete them after a certain time. (You can use the date property Recent conversion date to do this in lists.)

Reminder emails are possible but again require a Marketing Hub Professional subscription to set up – and should be discussed with your legal person of contact.

can you explain how reminder e-mails could work?

Since the person did not accept the double opt-in, how can you use workflow to send a reminder?
