HubSpot provides robust subscription preference management, allowing contacts to subscribe, unsubscribe, and update their communication preferences at any time.
However, there is currently no equivalent mechanism for managing consent related to email and website tracking technologies, such as email open tracking, click tracking, and website activity tracking, as it now applies in France and Italy. (cf CNIL)
This creates a gap from both a user experience and privacy compliance perspective.
Proposed enhancement
Allow contacts to manage their consent for analytics and tracking technologies directly from the Subscription Preferences Center.
Contacts should be able to:
- View the current status of their tracking consent.
- Withdraw consent at any time.
- Re-grant consent at any time.
- Distinguish communication preferences from tracking preferences.
- Access a clear explanation of what data is collected and for what purpose.
- Have their consent changes automatically recorded in HubSpot for auditability purposes.
Why this matters
Subscription preferences and privacy preferences are fundamentally different concepts.
A contact may wish to:
- Continue receiving marketing emails.
- Stop being tracked for email opens, clicks, or website activity.
Today, HubSpot provides granular control over communications but not over tracking consent, forcing customers to build custom workarounds that are difficult to maintain and not easily accessible to end users.
Adding a dedicated “Tracking & Analytics Preferences” section to the Subscription Preference Center would improve transparency, user trust, and help customers meet evolving privacy expectations and regulatory requirements.
