April 14, 2026, Legal Update
HubSpot recently updated the following legal documents included in our Customer Terms of Service:
- General Terms (previously updated February 2, 2026)
- Product Specific Terms (previously updated February 2, 2026)
- Data Processing Agreement (previously updated February 2, 2026)
- Sub-Processors Page (previously updated February 2, 2026)
- Privacy Policy (previously updated February 2, 2026)
Additionally, HubSpot also recently updated the following documents, which we are including here for your convenience, that may apply to your use of our services or websites:
- Website Terms of Use (previously updated January 3, 2024)
We’ve also made minor drafting clean-ups and clarifications across the terms.
We wanted to give you some information on what’s changed below. Please remember that this is just an informal, high-level summary of the most recent changes to these documents, and that you should always make sure you’ve read and understood the complete Customer Terms of Service before you use our products or services.

General Terms
- In the General Terms ‘Fee Adjustment’ section, we’ve clarified the language to better reflect your option to choose to not renew in your account settings.
- We moved notice information in the ‘Suspension for Present Harm’ section to the beginning of the provision in an effort to clarify how we would communicate in those instances.
- The ‘Machine Learning and AI’ section now reflects your ability to manage your preferences for contributing to HubSpot’s AI model training directly from your account.
- We’ve updated HubSpot Terms Tips across the Agreement in an effort to help you quickly and easily find information you need.
- If you’re a customer purchasing through the AWS Marketplace, we’ve updated the General Terms that apply to you with the same changes to the ‘Suspension for Present Harm’ and ‘Machine Learning and AI’ sections. We’ve also updated the ‘Fees’ section and overages details to remove references to upgrades that do not apply to purchases through AWS Marketplace.
Product Specific Terms
- In the Product Specific Terms, we’ve added information to the ‘HubSpot Smart CRM and Free Services’ section indicating some services may be offered as a standalone service. You can learn more in the Products and Services Catalog.
- In the ‘HubSpot Credits and AI’ section under ‘HubSpot AI’, you’ll find additional details about how action-based features and resolution-based features use HubSpot credits based on the rates detailed in the Products and Services Catalog.
Data Processing Agreement
- In the Data Processing Agreement, we’ve refined the language in the introduction for consistency.
- We’ve updated the ‘Scope’ section of the ‘Controller-to-Controller Terms’ to clarify those terms apply when Intent data sharing is enabled.
- Updates to Sub-Processors are described in the Sub-Processors Page summary.
Sub-Processors Page
- We’ve added Hyperdoc, Inc. to our Sub-Processors Page providing meeting recordings and transcripts in HubSpot AI services.
Sensitive Data Terms
- We’ve updated the Sensitive Data Terms to align available beta services, if any, with the Sensitive Data section of the Product & Services Catalog.
Privacy Policy
- We updated the ‘HubSpot Events’ section of the Privacy Policy to remove references to specific events and streamlined language to cover all HubSpot events with transparency.
- We’ve updated the ‘Google Drive Integration’ and ‘Google Search Console’ sections to align with updated Google integration information.
