Legitimate interest with optional subscriptions

We have a contact form that is set to legitimate interest only - we're not sending marketing information to these users only responding to their requests.

We'd like them to optionally be able to opt-in to marketing subscriptions as well during the form completion. I'm unable to see such option within the form settings - am I missing something?

When your form notice and consent is set to legitimate interest...

... then you should see this left sidebar after clicking the notice and consent text on the right:

By clicking into the dropdown "Subscription Type", you can select multiple subscriptions.

This works if I want to use legitimate interest for all subscriptions - but I want this to be an optional opt-in for anything other than 1:1 comms (which is the legitimate interest).

Make sense?

Hi @WillJV,

I'm not sure I'm following.

Do you want subscription opt-in to be optional in forms? If so and if a contact does not check that box, HubSpot would automatically exclude them from emails of that subscription type.

If you want contacts to be able to receive emails despite not having an opt-in for a subscription type, you could still enable the GDPR settings but you couldn't check the "Legal basis required" box.

Hi Karsten,

In short, this is a contact form - we've got legitimate interest to contact that person as they've filled out a form with the expectation of receiving a 1:1 response. They have not signed-up for marketing communications though.

So we want to be able to:
- Use legitimate interest (no checkbox) for 1:1 sales communications

- Have an optional checkbox for the user to opt-in to marketing communications.

Make sense?

Hi @WillJV,

With the GDPR settings enabled, you can still send emails of both subscription types to a contact, regardless of whether they check the marketing box or not.

With legal basis required in the settings checked, you can only send them marketing emails if they actually check the box.

I don't think you're following, I appreciate the nuance of what lists someone is subscribed to... but how do I give them the optional checkbox alongside the legitimate interest? There doesn't appear to be an option to add that optional checkbox.

I.e I DONT want to send marketing communications to users that have not signed up for it...

Hi @WillJV,

Ah, understood. That's unfortunately not possible. You can't work with both legitimate interest and consent checkboxes in forms.

You would have to create a custom checkbox and use a workflow to update the subscription status of a contact. That checkbox would however sit above the consent notice text.
